DLW faces trouble for non-payment of Tax

U.P.Commercial Taxes department stops Form 38 downloading facility for DLW

UP CTD DLWVaranasi: The Diesel Locomotive Works (DLW) of the Indian Railways on Saturday, landed in trouble when commercial tax department of UP stopped the facility of downloading Form 38 (form of declaration for import) through its eSancharan portal for the non-payment of commercial tax (entry tax) since 2007-08 financial year. The department has also warned DLW to seal its workshops in case of more delay in clearing the dues.

Joint commissioner (corporate circle Varanasi) of commercial tax department Satyapal Singh informed reporters, “The DLW has not deposited its commercial tax since 2007-08 financial year. The dues of DLW had been estimated to Rs 28.50 crores as basic amount of the tax while interest on dues had touched the mark of Rs 31.07 crores. Besides, the tax assessed in financial year 2012-13, 2014-15 and 2015-16 as well as interest amount has also not been cleared by this unit.” DLW had cleared commercial tax till 2000-01, he said. The department did not assess commercial tax to be charged from DLW between 2002 and 2007, which is a matter of internal investigation, said Singh.

Against the delay by the DLW in clearing the commercial tax, he said, warnings to stop the facilities of downloading Form 38 through eSancharan had been issued to it in December 2015 and again in January. But, when the officials of DLW failed to respond or clear the dues against the warnings the department decided to stop this facility from Saturday, said Singh mentioning that now importing any article inside its workshops will become impossible for the DLW due to which the production will also be affected.

He also made it very clear that in case of more delay in clearing the dues of commercial tax department the DLW workshops can also be sealed. He mentioned that commercial tax department had already initiated action like sealing a railways workshop in Jhansi in March 2013 against the non-payment of commercial tax.

Reacting over this action of commercial tax department the public relation officer of DLW Pradeep Mishra informed that the matter has come to the knowledge of senior officials and the DLW will appeal against it before the official concerned.
