LUCKNOW: Refusing to intervene in the construction of railway overbridge overlooking the BSP office in Mall Avenue, the Lucknow bench of Allahabad high court on Tuesday observed that the construction was in public interest. The court dismissed a PIL challenging the said construction in the area. A bench of Justice Imtiyaz Murtaza and Justice VK Mathur said, “The apprehension of the petitioner that the proposed construction would attract serious problems or will not be in public interest, has no legs to stand on.”
“We find no reason to infer that the proposed construction of a railway overbridge would be made in an unauthorised manner or in contravention of the provisions of the laws relating to developmental activities,” observed the judges.A Rajajipuram resident Anjani Kumar had filed the PIL challenging the decision of state government to construct a railway overbridge at railway crossing gate number 214-SPL near 104 Mahatma Gandhi Marg. The petitioner questioned the construction mainly on the ground that it was being taken up on the land of Lucknow Cantonment Board, whereas NOC was not obtained from the board.
