मुंबई Mumbai: The city’s Metro and Monorail stations built in the middle of public roads are illegal, it has emerged. The Mumbai Metropolitan Region Development Authority has written to the state urban development department to make amendments to the present government rules so that constructions of future metro routes can be done as per the legal framework.
The stations of the Metro Phase One and Mono are constructed by the MMRDA under the Indian Tramway Act.
“But there is no provision in the Maharashtra Regional Town Planning Act or the Development Control Rules that speak about the construction of Metro or Mono stations in the middle of the road. The construction seems to have not been questioned as it is executed by a government body,” said a senior MMRDA officer.
MMRDA Commissioner UPS Madan confirmed that a letter was sent to the state for amendment of laws and treating MMRDA as the planning authority for the project.
A senior MMRDA officer said, “Currently the MRTP and DCR are not adequate to cover Metro or Mono since the stations are either underground or elevated. The railway stations are over road. The DCR has no provisions for these elevated or underground stations. We had treated the Metro One and Mono Phase One as railway projects and had managed to initially and got it exempted from the project authority, ie the BMC.”
A senior UD officer said they have received the letter from the MMRDA on November 19 and are considering various amendments. Three new routes of the Metro have been sanctioned by the state government – Seepz-Bandra-Colaba; Dahisar Charkop; and Wadala-Ghatkopar-Thane-Kasarvadavli.
These are to be executed by the MMRDA, but there is no clear policy under which the project can be undertaken. The new projects are under a new Metro Act. “When the BMC commissioner visited the metro stations of Phase one for final sanctions, he and the fire brigade department had raised the issue on what basis the NOCs for stations were to be given since there was no provision under DC Regulations or MRTP for Metro or Mono stations,” said a MMRDA officer.
